Honor Council Honor Hearing Panel Script*

*This is only an example of a script that will be used in the actual hearing. In the actual hearing, all names will be furnished, as will the specific violation that is alleged to have occurred.

I) Introductions

A) Turn on the recorder

*"This begins the meeting of the Kansas State University Honor Council Hearing Panel. The time is 3:30 p.m. on Tuesday, February , 2006.

B) *"An Honor & Integrity System hearing is an educational opportunity for all the participants. In adhering to the Honor & Integrity System’s underlying motto, hearing panelists uphold academic integrity, aid student moral reasoning through questioning and reflection, and provide an example for students who are later confronted with the demands of citizenship. The Student Handbook, declaring student rights and responsibilities, states on page D5 of the Campus Phone Book, “Kansas State University is a community of students, faculty, and administrators who come together to learn, work, and grow intellectually. The concept of community is central to our belief in the importance of honorable behavior for oneself and for the community as a whole. The Honor & Integrity System is an assumption of trust which accompanies the student in all dealings with fellow students, faculty, and administrators.”

*"Members of the Honor Council compose the hearing panel before you. Student members of the Honor Council have been selected by the Student Body President and approved by Student Senate. Deans nominate faculty members and are approved by Faculty Senate President and the Provost. The Dean of Student Life selects at-large staff members.
The Associate Provost for Diversity selects at-large student members."

C) *"The Student members on this panel are:

_____ , Junior from the College of Engineering; and
_____ , Senior from the College of Human Ecology."

D)*"The Faculty members are:

_____ , Associate Professor from the College of Business Administration

E) *"My name is _____, Professor from the College of Arts and Sciences. My role is to chair the Hearing Panel"

F) *"This is Case # (Insert Case#) from the academic year of 2005/2006."

G) *"The Reporter of the alleged violation of the Honor Pledge is (Insert name and College affiliation)."

H) *"The Alleged Violator(s) of the Honor Pledge is (are) (Insert name and college affiliation). Present also is (Insert name of HIPE Advisor), an Honesty and Integrity Peer Educator who will serve as a Student Advisor to (Insert name of AV). (Insert name of Advisor) knows not to address the Hearing Panel directly unless asked to do so by the Chair."

I) *"The Case Investigators, both of whom are also members of the Honor Council are (Insert names and College Affiliation)."

J) *"Also present are Dr. David Allen, Honor & Integrity System Director and Dr. Helene Marcoux, Associate Director."

II) Pleading

A) Alleged violations are read aloud

* "(Insert name), you are alleged to have (Insert allegation) in (Insert class information) during (Insert semester). Do you understand the allegation?"

Alleged Violator responds.

B) Alleged Violator enters a plea:

*"You will now be given the opportunity to admit or deny the allegation. Whether you admit or deny the allegation, the Hearing Panel will hear information from the Case Investigators, from the reporter, and from you."

*"(Insert name), do you admit or deny (here, repeat the alleged violation."

Alleged Violator responds.

C) The Chair repeats to reaffirm the plea.

*"You have admitted (or denied) the allegation. The Hearing Panel now has the opportunity to hear information from the participants. Will the Case Investigator (s) please come forward?"

III. Presentation of Information

A) Case Investigator(s)-After acknowledgement, say...

* "Case Investigators, what information do you wish to present to the Hearing Panel?"

Case Investigators respond by explaining their understanding of the case and frame the question(s) the hearing panel must consider prior to a decision. Case Investigators conclude by saying whether sufficient information does or does not exist to support the charge of an Honor Pledge violation. Person(s) who may have further information about the allegation could also be presented during this time.

* "The Hearing Panel may ask questions of the Case Investigator(s)."

*"The Reporter may ask questions of the Case Investigator(s)."

* "The Alleged Violator may ask questions of the Case Investigator(s)."

B) Reporter(s)

*"[Insert reporter's name], as the reporter for Case #, do you have additional information to share or anything you'd like to say, clarify or emphasize which will help the Hearing Panel to fully understand this case?"

Reporter(s) responds with information, etc.

* "The Hearing Panel may ask questions of the Reporter(s)."

* "The Alleged Violator may ask questions of the Reporter(s)."

C) Alleged Violator(s)

*"[Insert name of AV(s), are you prepared to address the hearing panel?"

Alleged Violator responds.

After Alleged Violator acknowledges preparedness, say...

*"You have received a letter from the Honor & Integrity System Director notifying you of the Alleged Honor Pledge violation. The Director's letter asked that you notify him that you received the letter. Did you do so?"

Alleged Violator responds.

*"The Director's letter requested that you make an appointment with Dr. Helene Marcoux, Associate Director of the Honor & Integrity System, so that you could review the Honor & Integrity System Violation Report. Did you do so?"

Alleged Violator responds.

*"The Director's letter also included a reference to the Honor & Integrity System web page. Did you review that material?"

Alleged Violator responds.

*"Do you wish to add, clarify, present a witness or witnesses, or say anything to the Hearing Panel which will help us fully understand your case?"

Alleged Violator(s) responds with any information, etc.

*"The Hearing Panel may ask questions of the Alleged Violator(s)."

*"The Reporter may ask questions of the Alleged Violator(s)."

D) Presentation of the Witnesses

*"At this time all participants may introduce witnesses. Please remember that all witnesses and all questions for the witnesses must be in direct relation to the question of whether or not the Honor Pledge has been violated in this case."

*[Insert Case Investigators' names] as Case Investigators, do you have any witnesses to present at this time?

Case Investigators respond and if applicable present witnesses.

*"The Hearing Panel may ask questions of the witness."

*"The Reporter may ask questions of the witness."

*"The Alleged Violator may ask questions of the witness."

*[Insert Reporter's names] as Reporter, do you have any witnesses to present at this time?

Reporter responds and if applicable presents witnesses.

*"The Hearing Panel may ask questions of the witness."

*"The Case Investigator(s) may ask questions of the witness."

*"The Alleged Violator may ask questions of the witness."

*[Insert Alleged Violator's name] as the Alleged Violator, do you have any witnesses to present at this time?"

Alleged Violator responds and if applicable presents witnesses.

*"The Hearing Panel may ask questions of the witness."

*"The Reporter may ask questions of the witness."

*"The Case Investigators may ask questions of the witness."

Rebuttal

*"Do the Case Investigator(s) have anything further to add or clarify?"

*"Does (do) the Reporter(s) have anything further to add or clarify?"

E) Concluding Statement

* [Insert names of alleged violator(s), you may now make a closing statement to the Hearing Panel."

The Alleged Violator(s) makes a closing statement to the Hearing Panel.

IV) Deliberation

A) Introduction

* "The Hearing Panel will now meet in closed session to deliberate on this case. You will be recalled once the Hearing Panel has reached a decision."

B) The Hearing Panel meets in closed session to deliberate the case. Turn off the recorder. The Hearing Panel should decide on the validity of the allegations first.

C) Violation...The Hearing Panel needs to determine whether an Honor Pledge Violation occurred. If so, the hearing panel will then decide on an appropriate sanction for the violation.

D) No Violation...If there is a finding of no violation, the Alleged Violator(s) should be recalled, notified of the decision, and dismissed. If the Hearing Panel decides that there is not an Honor Pledge violation in a case where a faculty member has imposed a sanction, the Hearing Panel should request that the Director be called in to consult regarding the options available.

E) Sanctioning...The Hearing Panel should determine a sanction appropriate to the violation. The Hearing Panel has the authority to mandate an original sanctioning. (Consultation with the Director is recommended if the panel chooses this form of sanctioning.) Prior violations may be considered when determining sanctions. The Hearing Panel Chair asks the Honor & Integrity System Director whether the Alleged Violator has been found responsible for a prior Honor Pledge violation.

During deliberation, only the Hearing Panel Chair may consult with the Director or Associate Director.

If appropriate, members of the Hearing Panel may include a comment or observation while presenting their decision.

V) Notification of Decision

A) The Alleged Violator(s) should be called in.

*Turn the tape recorder on.

B) If the decision was a finding of no violation, read this:

*"The Hearing Panel has discussed your case and has determined that clear and convincing information does not exist to find you in violation of the Honor Pledge. You will be notified in writing of this decision within 48 hours of the close of this hearing."

OR

If the decision was a finding of violation, read this:

*"The Hearing Panel has discussed your case and has determined that clear and convincing information does exist to find you in violation of the Honor Pledge."

*" As a result of this finding you have been assigned the following sanction(s):

*"Our decision was made consistent with the Honor & Integrity System Constitution and Investigation and Adjudication Procedures. You may appeal this decision only on the basis of substantial new information or procedural irregularities as stated in Article V of the Investigation and Adjudication Procedures of the Honor & Integrity System.

I will remind all of the participants to not discuss the content nor the results of this Honor Council Hearing Panel with anyone outside this room. The results of this hearing are to remain confidential.
